These Terms of Service (“Terms”) govern your use of charcounting.com and our landing pages at charcountingpg.com, the quizzes, forms, scheduling pages and other online tools we offer there (together, the “Sites”), and the text messages and emails we send you. The Sites are operated by Charcounting CPA, PLLC (“Charcounting,” “we,” “us,” or “our”). By using the Sites, submitting a form, booking a call, or opting in to messages, you agree to these Terms. If you do not agree, please do not use the Sites.
1. No professional advice and no client relationship
Quiz results, scores, estimates, articles, videos, emails and other content on the Sites are general information for educational purposes. They are not tax, accounting, legal or financial advice for your specific situation, and you should not act on them without professional advice. Using the Sites, taking a quiz, or booking a free call does not create an accountant-client relationship. A client relationship begins only when you and Charcounting sign a written engagement letter, and that engagement letter governs the services we provide.
2. Construction Tax Leak Inspection
- Price and payment. The Construction Tax Leak Inspection costs $395, paid when you book through our scheduling page. Payments are processed by our third-party payment and scheduling providers.
- Credit toward a retainer. The full $395 is credited toward any monthly Charcounting retainer you start, as stated in the offer.
- Cancellations and refunds. If you cancel or reschedule at least 2 business days before your scheduled call, you receive a full refund. Cancellations made later than that, or missed calls, are not refunded, because we limit the number of inspections each month.
- Documents and timing. We deliver the written report within 10 business days after we receive the documents we request. Timing depends on you providing complete documents.
- Scope. The inspection is a one-time review that identifies possible opportunities and gives estimated ranges. It is not a tax return, audit, attest engagement or guarantee of any tax outcome or savings.
3. Free calls
Free introductory calls are offered at our discretion to help you decide whether our services fit. We may decline, reschedule or limit free calls. Nothing said on a free call is professional advice for your specific situation.
4. Text message (SMS) program
Program name: Charcounting SMS. Sender: Charcounting CPA, PLLC.
Non-marketing messages. If you check the non-marketing consent box, we may text you about your quiz results, your Construction Tax Leak Inspection booking, appointment confirmations and reminders, and account or service updates.
Marketing messages. If you separately check the marketing consent box, we may also text you tax tips, deadline reminders, educational content and special offers.
Consent to receive text messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out; we will send one message confirming your opt-out. Reply HELP for help, or contact info@charcounting.com or (980) 456-1137. Carriers are not liable for delayed or undelivered messages. To rejoin, opt in again the way you did originally.
We do not sell, rent or share your mobile phone number or text-messaging opt-in consent with third parties or affiliates for their marketing purposes. Opt-in data and consent are shared only with service providers that help us deliver messages to you. See our Privacy Policy.
5. Email
When you submit a form or book a call, we may send you emails about your results, your booking and our services, including a short email series and a weekly newsletter. Every marketing email includes an unsubscribe link, and you can unsubscribe at any time.
6. Information you provide
You agree that information you submit is accurate and that you are authorized to submit it. Please do not send Social Security numbers, bank account numbers, tax returns or other sensitive documents through website forms, text messages or regular email. We will provide a secure upload method when documents are needed. Our Privacy Policy explains how we collect and use personal information.
7. Acceptable use
You agree not to misuse the Sites, including by submitting false information, interfering with the Sites’ operation, attempting unauthorized access, scraping content, or using the Sites for any unlawful purpose.
8. Intellectual property
The content on the Sites, including text, quizzes, graphics, videos and logos, belongs to Charcounting or its licensors and is protected by law. You may view and print it for your own personal, non-commercial use. You may not copy, modify, distribute or sell it without our written permission.
9. Third-party services
The Sites use and link to third-party services, such as scheduling, payment, video and messaging providers. Their terms and privacy policies govern your use of those services, and we are not responsible for them.
10. Disclaimers
The Sites and their content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular tax result, refund or amount of savings.
11. Limitation of liability
To the fullest extent permitted by law, Charcounting will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Sites or their content. Our total liability for any claim related to the Sites or the Construction Tax Leak Inspection will not exceed the amount you paid us for the inspection, or $100 if you paid nothing. Services provided under a signed engagement letter are governed by that engagement letter.
12. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Mecklenburg County, North Carolina, unless applicable law requires otherwise.
13. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continuing to use the Sites after an update means you accept the updated Terms.
